Administrative Law (TOL210)

Administrative law is a legal subject that deals with the legal rules on the manner of treatment in administrative matters. The central parts of the subject constitute an overview of what administrative activities are, and which case management rules apply to the various types of activities. The subject thus also provides knowledge about what rights citizens have vis-à-vis the administration. There will be a particular focus on the rules on customs administration. The subject also includes an introduction to the constitutional framework that applies to the relationship between the state powers.

Content

Administrative law is the legal rules on the manner of treatment in administrative matters, and on the rights and duties citizens have towards the administration. The general rules on the procedure in administrative matters are set out in the Administrative Procedures Act. Some of the administrative law's themes are the duty of guidance, requirements for impartiality, right of access, justification and right of appeal. The subject also deals with the special rules on customs administration in the Transport of Goods Act, Chapters 7 and 13 and the Customs Excise Act, Chapters 8 and 11. These include, among other things, rules on the customs authority's duty of confidentiality, other authorities' obligation to provide information to the agency and special procedural rules in trade measures cases. The subject also includes an introduction to the constitutional framework that applies to the relationship between the state powers.

Learning outcome

After completing the course, the student will achieve the following learning outcomes defined in terms of knowledge, skills and general competence:

After completing the course, the student will have:

  • knowledge of the main features of the Norway’s state constitution
  • knowledge of administrative activities and the administrative apparatus
  • knowledge of the requirement of rule of law in administrative law
  • knowledge of the rules on organization, responsibilities and decision-making competence in the public administration
  • knowledge of the rights and duties citizens have towards the administration
  • knowledge of the rules on administrative proceedings
  • knowledge of special procedural rules in the Transport of Goods Act, Chapters 7 and 13 and the Customs Duty Act, Chapters 8 and 11

After completing the course, students should have the following skills:

  • identify and discuss legal issues in constitutional law
  • apply the administrative procedural rules
  • analyze and discuss the principles that apply in administrative law
  • explain the structure of state and municipal administration
  • demonstrate knowledge of special customs administration rules

After completing the course, students must have general competence in:

  • how different cases are to be handled by the public administration
  • how to apply basic principles of administrative law to relevant issues in administrative law
  • planning and execution of varied tasks and projects that extend over time, alone and as a participant in a group, and in line with ethical requirements and guidelines
  • the procedural administrative law

Coursework requirements

1 Assignment
One compulsory assignment must be approved in order to take the exam. The assignment can be of a theoretical or practical character. The assignment can furthermore be organized as a group submission. Further information, such as the deadline for submission, will be announced on Canvas at the start of the course. Form of assessment: Approved/not approved

Method of work

The course is a full time study. Forms of teaching are varied and include lectures, seminars and one compulsory assignment. Students are expected to work independently and it is assumed that the students come prepared for the lessons.

Course assessment

There must be an early dialogue between the course supervisor, the student union representative and the students. The purpose is feedback from the students for changes and adjustments in the course for the current semester.In addition, a digital course evaluation must be carried out at least every three years. Its purpose is to gather the students experiences with the course.
